Can Loan Settlement Lawyer Help With One Time Settlement?

Defaulting on your EMI can put you in an uncomfortable position. When you start missing multiple instalments it becomes difficult to carry on with your daily life. The phone calls from recovery agents start coming in. There may be higher interest rates applied to your loan account due to late payments. So what is the bank going to do?

Say there is a person working as an employee in Noida. He has a loan of 8 lakhs from a bank. For past two years he has been paying his EMI on time. Due to some unfortunate circumstances he loses his job. The household income falls apart. All the savings get consumed and he starts paying off his credit card EMIs. He ends up not paying three EMIs.

Now the bank wants all his pending dues. The recovery agents start calling him day and night.

He finds it hard to cover his household expenditure. He wants to pay off his loan but is not able to pay according to his repayment plan.

Will the bank accept a lesser amount and clear his loan?

A Loan Settlement Lawyer can negotiate with the Bank or any other loan provider which offers loan settlement to reach a settlement. They can find out the amount you owe to the bank. Find out your repayment capacity. Create a settlement proposal and send it to the bank. If the bank accepts your proposal then your loan can be closed for a lower amount.

This is called One-Time Settlement (OTS). It is an agreement between the borrower and lender for the lender to receive a particular amount and forgive a certain percentage of your loan that you owe.

One time settlement is not something you are legally entitled to.

Every borrower who can't afford their monthly payments will not be able to settle their loan with the bank for a lower amount.

What loans can you apply for One Time Settlement on?

There are different types of loans that people borrow from the banks. Some can have collateral and some can be unsecured. Depending on the type of loan you took out you may be able to settle your loan or not.

Loan Settlement

Loan Settlement Personal Loan

Most loans are given out without any collateral.

If you have a personal loan from a bank and can't keep up with your EMIs you can try and reach an agreement with the bank.

They will take a look at your income and whether you can pay the EMI that you have agreed to on your loan contract. If it seems like your issue is just a temporary one they may offer you to restructure your loan and pay less every month.

You can consult with BK Singh Advocate to help you understand what you can do with your personal loan.

Credit Card Settlement

Credit Cards can get out of hand if you aren't careful with spending. Paying interest on unpaid balance can quickly increase the amount you owe on your card.

A Settlement can be reached with your bank if you can't pay your full balance on your card. Make sure to check your card statement and see how much you actually owe the bank before agreeing to settle.

Keep in mind that settling a credit card can hurt your credit score and you may find it difficult to apply for loans or other credit cards in the future.

Business Loan Settlement

There are many small businesses that struggle to make ends meet. Whether it's a slow market or loss of sales. Small business owners can face hardship when it comes to paying off their loans.

If you have taken out a loan for your business you may have your director or partner sign as a guarantor. You need to know if the bank will allow a settlement to be done on your behalf or if the guarantor will have to settle their portion of the debt.

Home Loan Settlement

Mortgage loans usually involve property that has been mortgaged to the bank.

Banks have the right to take legal action and recover their dues through the property that was handed over.

Make sure that the settlement includes your mortgage and any other collateral you gave the bank to secure your loan.

You will have a bank trying to take your property if you don't resolve your debt issue. Having a settlement agreement can help protect your home from being foreclosed.

Loan Against Property

When you mortgage your property to take out a loan it can cost you a large amount of money. If your not able to keep up with your EMIs the bank may look to recover their amount by selling your property.

You can ask to settle your loan against property for less than the amount you owe. This may result in the bank releasing their claim on your property and giving back the original title deed.

Documents Needed For One Time Settlement On Your Loan

You will need to show the bank certain documents to help prove that you owe them money and why you are unable to pay.

Keep all the documents with yourself. When the bank asks for copies make sure they are clear and legible.

Don't lie to your bank about your income or create false medical certificates to help you with a loan settlement.

Some borrowers will end up paying for OTS services from unknown sources. Make sure that you know the difference between paying the bank and a loan settlement service provider.

A good Loan Settlement Lawyer will let you know how much you will be paying for their service before working with you.

Can the bank take legal action if I want to settle my loan?

If you contact your bank about reaching a one time settlement it does not mean that they can't pursue you for their amount that you owe.

You can't expect a bank to drop their claim just because you sent them an email requesting an OTS.

If you can't pay a loan from your bank you will have to face a civil proceeding from the bank to recover their amount.

There are no criminal charges that can be brought against you for not paying off a simple loan. Unless you committed fraud or some other offence while taking the loan.

Can the Bank Foreclose your House?

If your loan is secured under the SARFAESI act they will have more options available to them.

Section 13(2) of the SARFAESI act states that the secured creditor can send you a notice and you have 60 days to pay off your loan.

They will then follow suit with further steps as mentioned in section 13(4).

If you feel that the notice was wrongly served you can file an application before the DRT as per section 17. Within 60 days of receiving the notice.

There are other cases where the bank isn't allowed to take action under SARFAESI act. Our legal team can examine your case and let you know what your best option is.

If you have already received a notice from the bank under SARFAESI can you still apply for a one time settlement? Yes you can still apply for a one time settlement even if you've received a notice. But again this is at the banks discretion.

You will have to inform the court that you have entered into a settlement agreement and what you will be doing about your loan account. Loan Settlement Lawyer can help you with your one time settlement agreement and see if the terms will resolve the court case.

Just because you applied for a settlement doesn't mean you don't have to abide by the time limits imposed on you.

Will one time settlement ruin your credit score?

When you enter into an agreement with your bank to settle your loan for less. There is a chance that it will lower your credit score. If the bank reports that you have defaulted on your loan and settled for a lesser amount.

Your credit information company can tag your loan account as having been settled instead of paid.

There is no way to remove your previous defaults and have your CIBIL score reflect as though nothing happened.

Why does it matter if I have a settled account?

If you want to take out loans or apply for credit cards in the future you will need to build back up your credit history.

Settling your loan will leave an imprint on your credit history that the bank knows you haven't paid your loan in full.

Once you complete your settlement it may take a while for your credit score to improve. Based on how much you pay towards the loan in the future.

There is no guarantee that your credit score will improve after a loan settlement.

Can I correct my Credit Report?

If your credit report shows incorrect information you can dispute it with your credit information company. They will then work with the lender to correct the error.

RBI has stated that Credit card dues need to be updated within 30 days of settlement. If you believe your credit report is not showing the correct information contact us.

Keep in mind that if the information on your credit report is correct you will not be able to challenge it just because it hurts your credit score.

You need to ask how the bank will be reporting your loan account once you've completed your settlement. Our lawyers will make sure that the loan settlement contract is in your favor as much as possible.

Loan Settlement vs Loan Restructure and Loan Waiver

As we have discussed before you can enter into a loan settlement with your bank. But what if you need help repaying your loan. There are other ways the bank can help you.

Loan Settlement Vs Loan Restructure Vs Waiver Table

Here are some of the ways you can negotiate with your lender.

If you can't pay your monthly installment because your income has decreased. It may be beneficial to ask your bank to restructure your loan so you can pay a smaller amount.

If you are in a worse financial situation than that and don't think you will be able to pay back your loan. Then a one time settlement may be your best option.

Will reducing your EMI work for me?

Paying a lesser amount every month may seem like a good idea. But will you end up paying more in the long run due to increased interest on your loan?

Ask your loan settlement lawyer to break down how you would benefit from lowering your EMI vs staying with the same EMI.

Can the bank waive my interest and charges?

Depending on what the bank's policy is they can choose to waive your interest. If your loan account has accumulated too many charges on it you can also argue that they shouldn't be charged for the additional interest.

There is a difference between getting the bank to waive interest on your loan. And getting the bank to reduce the charges if they were charged incorrectly.

Can Debt Consolidation help me?

You can combine your debts into one by taking out a new loan or line of credit. As long as you have the funds to pay the loan you may want to look into consolidating your debts.

Don't fall into the trap of taking on more debt just to pay off the old debt.

Common Mistakes Borrowers Make While Doing An OTS

As mentioned above there can be negative consequences from settling your loan. Let's take a closer look at what not to do when you're negotiating your loan settlement.

Pay without getting a written agreement

A one time settlement can fail if you don't receive written approval from the bank. Make sure you have some kind of documentation from the bank that shows you have an agreement in place. Email, chat or even phone call will not be enough. Always get everything in writing from your authorized loan officer.

Your agreement should include your loan number and how much you will be paying to the bank.

Give yourself enough time to pay

Just because the bank has lowered your payment amount doesn't mean you can easily pay it off.

Many times when you are offered an OTS you'll be given a timeframe in which to pay your loan off. Make sure you can comfortably pay the settlement within that time. Or else the bank will void the agreement and take action on your loan account.

Try and not reach a payment plan you can't afford.

Your guarantor may have to pay

As we said earlier you may have someone helping you out with your loan. A co borrower or guarantor may have signed on the loan as well. When it comes time to settle your loan the bank may expect them to pay their portion of the debt.

Have a Loan Settlement Lawyer make sure they are released from any liability on your loan. Otherwise you can run into legal issues later on.

All your loans aren't included in the agreement

You may have taken out a personal loan from the same bank that you have your credit card from. Just because your personal loan is being settled doesn't mean your credit card will be.

Make sure all your loan accounts are being included in the settlement.

Not getting documents after settlement

Always keep a copy of your receipts after paying off your loan settlement. Have the bank issue you a closure certificate so you can show that you have paid your loan in full. If you have any property pledged as collateral make sure the bank releases your title deed and gives you your original documents back.
