What started out as a missed EMI becomes an issue for your family when an NBFC agent starts harassing your wife, parents, siblings, friends or employers. You may already be stressed about your finances. But harassing your relatives creates additional embarrassment, fear and completely unnecessary family drama. Agents can contact relatives of a borrower in certain situations, especially if those individuals are co-applicants or guarantors or otherwise involved with the loan. But that does not allow an agent to threaten, shame or intimidate family members of the borrower at will. In fact, RBI instructions specifically prohibit harassment and intimidation and mention privacy of debtors' relatives, referees and friends. If you find yourself getting NBFC recovery calls for a loan in Delhi NCR, Noida, Ghaziabad, Gurugram or anywhere else in India, take a deep breath. The first step is to document the calls, find out who is calling you, confirm details about the loan account and contact the NBFC through its grievance redressal process. Loan Settlement Lawyers can help you figure out if the calls are just part of the recovery process, a grievance that should be escalated or if you should speak to a lawyer about legal options. We can do the same analysis to determine your options if you want to restructure your loan or choose OTS or loan settlement. Contacting a relative doesn’t amount to wrongful recovery automatically. The context is important. A co-borrowing or guaranteeing spouse is in a different position to the aged parent of the borrower who has no link with the loan agreement. In its 2022 directions, RBI said regulated entities are accountable for their recovery agents’ actions. The directions bar “intimidation” or “harassment” including “behavior which is aimed at the public humiliation of the debtor or otherwise abuses or insults him or attempts to intrude upon the debtor’s privacy or that of his family members, referees and friends”. The directions also place a prohibition on threatening or anonymous calls. Recovery calls also can’t happen before 8:00 a. m. or after 7:00 p.m. On digital lending, RBI has separately emphasised on data privacy and fair recovery. REs will continue to be liable for the acts of their lending service providers. Details of recovery agents will also have to be shared in the digital lending space. That line becomes important in Delhi, New Delhi, Noida, Greater Noida, Ghaziabad, Gurugram, Faridabad and elsewhere across India. Just because a borrower is under financial stress, doesn’t mean he can be publicly shamed or abused while recovering the loan. Read boiled down. When RBI discusses recovery calls to relatives, assess the borrower’s ties to the loan and conduct & intent of the call. Assume the borrower defaulted on personal loan and lender’s collection agent calls father. If father isn’t borrower/guarantor, legal & regulatory concerns aren’t the same as if father signed documents as guarantor. Intent also factors into agent behavior. Professional request to have borrower call lender is different than agent telling family member borrower’s a fraudster; threatening them; calling their work repeatedly; or using profanity. Guidelines on the responsibilities of regulated entities that employ recovery agents are also laid down by the Reserve Bank of India. While the Directions by RBI dated 12 August, 20 22 on Recovery Agents state that the responsibility for outsourced functions vests with the regulated entity, it specifically mentions against intimidation/harassment and makes reference to privacy of family members and referees/friends. All this also operates alongside the RBI's wider regulatory framework for NBFCs as well as the contract between lender and borrower and any other applicable laws. With regards to digital lending agreements specifically, RBI’s Digital Lending Guidelines cover topics such as privacy, collection of data, lending service providers, and recovery. Digital lending complaints are also addressed by RBI requiring regulated entities to have a grievance-redress mechanism to handle these types of complaints. If you’re a borrower dealing with a problem with your lender, don’t jump to conclusions that it is a criminal matter. Just because NBFCs have the contractual right to recover amounts due, doesn’t mean they can do just anything to recover the money. Take screenshots of any WhatsApp messages, SMS messages and emails. Note down numbers from where calls have been received. Record date, approximate time of call, name given by the caller, name of the agency, if any and what was communicated during the call. If your family member is the receiver of the call, ask him/her to immediately write down what transpired during the call when it's still fresh in their memory. Do not provoke them to ask questions to or confront the recovery agent. After making a note of these details, approach the NBFC directly through its official customer-care or grievance- redressal channel. Provide the NBFC loan account details and inform them clearly that recovery is being done from someone who is not liable for the loan amount, if that is true. Wherever necessary ask the NBFC to provide the details of the authorised recovery agency/particulars of the officer handling the loan account. Loan Settlement Lawyer can help a borrower analysing the documents and file a written complaint taking the matter forward, if facts allow. Yes, the borrower has the right to escalate the complaint to the concerned regulated entity if the method of recovery is found to be at variance with the RBI directions or the lender’s own grievance and fair- practices code. The complaint should not contain any hyperbole but must state facts. Who called whom, what exactly was said during the calls, how many times the calls were made and whether the person being called had any relationship with the loan are details to be mentioned. RBI’s Integrated Ombudsman scheme offers borrowers an alternative complaint-redressal channel for eligible complaints relating to service deficiency by regulated entities. The Reserve Bank–Integrated Ombudsman Scheme, 20 26 came into effect on July 1, 20 26, superseding the Ombudsman Scheme, 20 21 for complaints relating to matters covered under the new scheme. As a practical first step, however, is still relevant: always approach the concerned regulated entity via its own grievance redressal channel and obtain an acknowledgement of your complaint. Subject to the relevant scheme and facts of the case, the complaint can then be escalated to the RBI’s grievance-redressal mechanism, if it qualifies as an eligible complaint. A Loan Settlement Lawyer can guide the borrower on paperwork and escalation channel before filing such a complaint. That changes if the relative signed the loan paperwork. A co-applicant can have contractual liability on the loan. A guarantor can have legal liability on the guarantee. Calling someone a “relative” does not establish liability. For that reason, borrowers should be skeptical of generic information telling them that an NBFC will “never” call relatives. The agreement matters. The person’s legal obligation on the debt matters. How the lender tries to recover also matters. If a parent, spouse, sibling or business partner signed on as a guarantor, ask for the loan and guarantee agreements before making claims that the NBFC is improperly contacting them. Loan Settlement Lawyer can review the documents and help you understand the difference between contractual liability and recovery actions that may constitute a separate complaint. Default does not legitimise every recovery tactic Remember that an NBFC can only recover what is legally owed to them. So if the loan, contract and account status permit it, the lender can demand payment, work out repayments, settle up, initiate proceedings or foreclose on security (wherever allowed by law). But equally RBI’s instructions also set out clear guidelines on how recovery agents should behave. So the borrower should not fall into either extreme behaviour. Don’t think that every call to recover the loan will be harassment just because it feels like it. Don’t think that an agent can threaten you or shame you in public just because you owe them money. A lawyer will generally require the underlying documents to provide advice of any substance. Retain your loan document or sanction letter, most recent account statement, repayment history and communications with the NBFC. Include any legal notice, settlement offer, recovery agent correspondence and screenshots of the above. If it is a business loan, you should also retain relevant business records that help demonstrate why it has become difficult to repay. To the extent settlement is being contemplated, the borrower's actual capacity to make a proposed payment is also commercially relevant. Loan Settlement Lawyer can review what you have and provide a useful assessment of whether the sooner issues relate to recovery conduct, settlement, restructuring, litigation or some combination. Legal advice is particularly beneficial if the matter has escalated beyond simple payment reminders. You may want to seek advice if collection agents contact unrelated family members multiple times about the loan, use threatening language, unnecessarily reveal debt information, send obscene messages or persist after you’ve sent a written complaint. Also speak to a lawyer quickly if you’ve been served with a legal notice, notice on a secured asset, court summons, tribunal notice or settlement offer with a short deadline to pay. Legal consultation at a distance can also make sense for Delhi NCR borrowers (Delhi, Noida, Ghaziabad, Greater Noida, Gurugram) where the dispute revolves around paperwork, notices, and communications. If the borrower is in genuine repayment distress, it may also be necessary to look at the borrower's overall financial position to evaluate settlement or an alternate repayment plan. Harassment and intimidation are generally not acceptable recovery tactics and intruding upon family members’ privacy may also be improper. If your relative co-signed or guaranteed the loan, this could affect their position. If your parents are not liable parties on the loan (co-applicants or guarantor) their rights are different than those who have guaranteed or contracted for the loan. Document and record if you receive repeated calls or confidential information is disclosed repeatedly. Save all records, messages, voicemails, etc. that document their activity. According to RBI instructions lenders should not make recovery calls before 8: 00 a.m. or after 7:00 p.m. for recovery of delayed loans. You should save and record any calls received outside of these hours. Yes. File a written complaint with the NBFC using their official complaints process. Keep a copy of the complaint, any acknowledgment they provide and all other evidence. The position of a guarantor differs from other family members. A guarantor is a co-signer on the loan. You should consult the loan paperwork and speak with your guarantor before escalating a situation. Settling your loan may be possible at the lender’s discretion.
